Update on Customs Clearance Post Ministry of Steel Policy Change: Case Scheduled for Hearing on December 1, 2025

I wish to share a significant development regarding my ongoing challenge with Customs Authorities at Nhava Sheva concerning the release of my goods.

Recently, the Ministry of Steel officially announced a postponement of BIS certification requirements for certain steel products, clarifying that non-QCO (Quality Control Order) items should not be subjected to unnecessary restrictions. Despite this clear communication, Customs officials continue to withhold the release of my consignment of Resistance Wire classified under IS 3725 / HSN 72299060.

For the past ten months, my raw materials have been detained without any valid legal justification. This has resulted in the closure of my factory, leaving my workers unemployed and causing significant hardship. In response, I have had to seek legal remedy through the Hon’ble Bombay High Court.

Key Update:

After persistent efforts, my writ petition has now been scheduled for hearing on December 1, 2025. This marks a crucial milestone, especially considering that just weeks ago, the case was not listed at all. Now, it is officially placed on the court’s calendar, providing a glimmer of hope for resolution.

Why This Matters:

  • The Ministry of Steel has confirmed that BIS/QCO certification requirements have been deferred for this category of products.
  • My product falls outside the scope of mandatory BIS coverage, as verified by RTI responses from BIS and Customs.
  • Nonetheless, Customs continues to detain my goods, severely impacting my operations and livelihood.

These delays have taken a toll both financially and health-wise, but with the court hearing scheduled, I remain optimistic that justice and clarity will be achieved soon.
