I recently made the difficult decision to let go of a part-time employee, primarily due to rising costs, frequent tardiness, and calling in sick during critical periods. As a small business with only one other staff member, I found their performance was becoming increasingly unsustainable.
This individual was hired nine months ago to assist with client care, including tasks like serving tea and coffee and managing cleaning duties. After eight months, I realized their impact on my finances was not justifiable, so I made the choice to terminate their employment.
Shortly after, I received a formal grievance outlining various accusations against me, including claims of illegal dismissal, health and safety violations, and insufficient holiday pay—none of which are true. In fact, I provided them with two weeks of notice pay as a goodwill gesture, even though legally, I was only obligated to give one week.
Among their wild allegations were claims about discovering inappropriate content on the company laptop, along with demands for compensation for the supposed stress caused. Interestingly, they insisted that I hadn’t noticed their significant weight loss due to stress—when in reality, I often saw them scrolling on their phone or taking extended breaks while I was the one putting in long hours for our business.
Given the threatening tone of their grievance, I felt it necessary to engage an employment lawyer to respond on behalf of my company and clarify that their accusations were unfounded and seemed almost generated by AI.
Despite lacking any solid evidence, they are still pursuing this matter with ACAS for early conciliation. They are now claiming that I was “consistently disrespectful and unprofessional” and that I failed to clearly communicate the cleaning aspect of the job—something I can readily prove was documented.
Has anyone faced a similar situation? I’m finding this incredibly stressful and struggling to focus on anything else.
To make matters worse, they’ve started contacting my lawyer, attempting to form a rapport, and threatening to take their story to the media if they don’t get what they want. Until their dismissal, no complaints were ever raised.
It feels like I’m caught in a bizarre drama straight out of a Netflix series!

I’m sorry to hear you’re going through such a stressful situation. It sounds incredibly challenging, especially for a small business. It’s unfortunate that dismissals can sometimes lead to retaliatory actions, and it seems like you’re doing the right thing by hiring a lawyer to help navigate this.
It’s important to keep a clear record of all communications and documentation related to their employment and their claims. Since you mentioned having evidence of their performance issues, this could be useful if the situation escalates.
Regarding their threats about going to the media or posting online, it’s essential to remain professional and not engage in any personal correspondence with them. Document everything and let your lawyer handle communications going forward.
Many small business owners have faced similar situations, often requiring legal advice to maintain their peace of mind and protect their business. Stay focused on your work and remember that you’re taking the proper steps to resolve this situation. It’s a tough position to be in, but with the right legal guidance, you’ll be better equipped to handle it. Hang in there!
I’m sorry to hear about your challenging situation; it certainly sounds overwhelming. It’s understandable to feel stressed when dealing with a former employee who seems to be retaliating. Documenting every interaction and maintaining thorough records of performance issues and communication can be crucial in these situations.
It might also be beneficial to seek guidance from your lawyer on your options moving forward, especially if they continue to escalate their claims. If the matter progresses to mediation or tribunal, having solid documentation could help protect your interests significantly.
Additionally, consider seeking support from local business networks or forums where you can share experiences and receive advice from others who may have faced similar challenges. You might find that there are strategies and insights shared by fellow business owners that can not only help you navigate this situation but also alleviate some of your stress.
Remember, you’re not alone in this; many small business owners have faced their own “dramas” and may have valuable advice to share. Stay strong, and I hope it resolves favorably for you soon!
